1. GENERAL CONDITIONS
1.a - This site ww.mubagioielli.it (hereinafter, "Site") is owned by Beauty Brass srl - Muba Gioielli (hereinafter BB srl Muba Gioielli) with registered office in Strada in Chianti - Florence (ITALY) Via Street Bull, 7/9 PI 03780580480.
1.b - These general conditions of contract (hereinafter, "General Conditions") govern the relationship between the customer (hereinafter, "Customer") and BB srl Muba Gioielli (jointly, hereinafter, "Parties") for the '' purchase of Muba Gioielli products (hereinafter, "Products") from time to time for this purpose made available on the Site.
The language available to conclude the contract is Italian.
1.c - For the purposes of these General Conditions, by Customer we mean only the consumer, that is a natural person who purchases the goods for purposes unrelated to the entrepreneurial or professional activity possibly carried out. The purchase of the product is regulated by Italian legislation.
1.d - The Customer is required to carefully read the terms and conditions of the General Conditions that have been made available to him on the Site, in order to allow them to be stored and reproduced by the Customer pursuant to art. 12 of the Legislative Decree 9 April 2003, n. 70. A copy of the General Conditions will in any case be sent by BB srl Muba Gioielli, by e-mail pursuant to the following art. 5.d of these General Conditions.
1.e - The contracts concluded with BB srl Muba Gioielli by accessing the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 (Consumer Code) and by Legislative Decree 9 April 2003, n. 70 (Implementation of Directive 2000/31 / EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce).
 
2. THE PRODUCT
2.a - The products available  for online purchase are bijoux in palladium galvanized brass, light gold, rose gold and ruthenium with Swarosky rhinestones. All Products are subject to availability at the time. BB srl Muba Gioielli reserves the right at any time to vary the limits on the quantity and / or type of goods that can be purchased online on the Site. The Customer will be informed if his order is not executable due to the unavailability of the ordered product.
 
3. THE PRICE
3.a - The prices of the Products are expressed on the Site in € (Euro) and include all applicable taxes or duties. Delivery costs are excluded, unless otherwise expressly indicated.
3.b - BB srl Muba Gioielli constantly checks that all the prices indicated on the Site are correct, without however guaranteeing the absence of errors. In the event that an error is found in the price of a product, BB srl Muba Gioielli will give the Customer the opportunity to reconfirm the purchase of the Products at the correct price or to cancel it.
 
4. PURCHASE
4.a - The essential characteristics and prices of the Products are shown in the offer relating to each individual product on the Site.
4.b - To purchase the Products, the Customer must complete and send the purchase order form in electronic format to BB Srl Muba Gioielli, following the instructions contained on the Site. The Customer must place the product in the appropriate "shopping" bag "and, after having viewed and accepted the contribution for delivery costs, as well as the General Conditions, Privacy Policy and the conditions on the right of withdrawal, must select the type of payment desired and choose the" order confirmation "option.
4.c - If the Customer needs to correct any data entry errors, he must follow the appropriate modification procedure contained in the Site, before submitting his purchase order. In particular, the Customer has the right to modify the quantity of the Products he intends to purchase, adding or eliminating one or more Products from the "shopping bag".
 
5. CONCLUSION OF THE CONTRACT
5.a - The Contract stipulated between BB srl Muba Gioielli and the Customer must be considered concluded when the order forwarded by the Customer - in compliance with the purchase procedure indicated on the Site and once the debit authorization has been obtained from the company issuing the credit card used by the Customer for payment - reaches the address of the Site. The order sent by the Customer will be binding for BB srl Muba Gioielli only if the entire purchase procedure has been completed regularly and correctly, without any indication of error by the Site. BB srl Muba Gioielli is not liable for malfunctions depending on the data transmission network manager.
5.b - By sending the order to BB Srl Muba Gioielli the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions.
5.c - The purchase order form will be filed in the Site database for the period of time necessary to process the orders.
5.d - BB Srl Muba Gioielli will send the Customer, by e-mail, a confirmation of receipt of the purchase order sent by the Customer, containing a summary of the General Conditions, Privacy Policy and the particular conditions applicable to the contract, including information relating to BB Srl Muba Gioielli, to the essential characteristics of the Products purchased, to the date and time of placing the order, to the address of BB Srl Muba Gioielli to which complaints can be made, to information on assistance services and guarantees existing commercial conditions, the conditions of withdrawal, the methods and times for returning or collecting the goods in the event of the exercise of this right, the detailed indication of the price, the payment method chosen by the Customer, the delivery costs. The Customer must immediately check the content of the communication and immediately report any errors or omissions to BB Srl Muba Gioielli.
 
6. THE PAYMENT
6.a - The Customer may pay the price of the Products and the related delivery costs by credit card. BB srl Muba Gioielli accepts payments made with the following credit cards:
    •     Visa
    •     MasterCard
The transaction will be charged to the Customer's credit card only after the credit card details have been verified, the debit authorization from the company issuing the credit card used by the Customer has been received, and the availability of the Product by BB Srl Muba Gioielli and therefore after the order will be ready to be processed.
 
7. TRANSPORT AND DELIVERY
7.a - For security reasons, the Products purchased on the Site will be delivered to the address shown on the credit card and the signature of an adult over 18 years of age will be required at the time of delivery.
No deliveries will be made to PO boxes and the order will not be processed.
7.b - For each order placed on the Site, BB srl Muba Gioielli will issue an invoice for the goods shipped, sending it by e-mail or post to the holder of the order, pursuant to Presidential Decree 445/2000 and Legislative Decree 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after its issue.
7.c - Delivery costs are charged to the Customer and are clearly highlighted in the order form. Customs duties and charges are the responsibility of the customer.
7.d - All purchases will be delivered by courier. Orders will be processed and delivered from Monday to Friday, excluding holidays and national holidays. BB srl Muba Gioielli is not responsible for unforeseeable delays, it being understood that, except in cases of force majeure, the Products will be delivered within a maximum period of 30 (thirty) days starting from the day following that in which the Customer sent the order to BB Srl Muba Gioielli.
7.e - Upon delivery of the goods by the courier, the Customer is required to check:
(i) that the number of items delivered corresponds to what is indicated in the transport document;
(ii) that the packaging is intact, not damaged, wet or otherwise altered, even in the closing materials. Any damage to the packaging and / or the product or the mismatch in the number of items or information must be immediately notified, placing a written control reserve on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered.
7.f - If BB Srl Muba Gioielli is unable to deliver the ordered goods following the unavailability, even temporary, of the Products, it will promptly notify the Customer, and in any case no later than 30 (thirty) days, by post electronics. The amount already paid by the Customer will be refunded as soon as possible, and in any case no later than 30 (thirty) days from receipt of the purchase order.
 
8. SHIPPING
8.1 - BB srl Muba Gioielli will send the Customer a confirmation e-mail once the Products have been shipped. With relative shipping number for product traceability.
 
9. RIGHT OF WITHDRAWAL FROM PURCHASE RETURNS AND CANCELLATION OF ORDERS
9.a - BB srl Muba Gioielli will reimburse the full cost of the Products that are returned by the Customer unused and undamaged, as well as accompanied by the relative invoice. All items are shipped with a label attached to the product. Returns and exchanges of these items will be accepted only if the label remains intact and attached to the product, and the above return instructions will be correctly followed. Refunds will be made with the same payment method as for the purchase. The purchased goods can be returned within a maximum of 15 (fifteen) days from the delivery date. Products purchased online cannot be refunded if the above conditions do not exist. Delivery costs are non-refundable.
9.b - The delivery costs for returning the Products are charged to the Customer; in addition to the customs fees that will be deducted in this way,  any cost incurred by the Customer for the return will not be refundable. BB Srl Muba Gioielli reserves the right to refuse the return of those Products that do not comply with the aforementioned requirements.
9.c - BB Srl Muba Gioielli will undertake to promptly reimburse the Customer no later than 30 days from the date of receipt of the written order for cancellation and return of the product pursuant to the previous point. BB Srl Muba Gioielli will send an e-mail notification once the refund has been made.
9.d - It is recommended to send the Products to be returned using an insured courier in order to trace the shipment.
BB Srl Muba Gioielli will not be responsible for reimbursement or compensation for those returned products that have been lost, stolen or damaged.
9.e - Pursuant to art. 64 of Legislative Decree no. 206/2005, the Customer has the right to withdraw from the contract without any penalty and without specifying the reason within the term of 15 (fifteen) working days starting from the date of receipt of the Products, without prejudice to the provisions of point  following.
9.f - To exercise the right of withdrawal, the Customer must send to the following address Via Torello Da Strada 7/9, 50027 Strada in Chianti Firenze, a written communication, with return receipt, containing:
the manifestation of the will to make use of the right of withdrawal pursuant to art. 64 of Legislative Decree 206/2005;
the indication of the Products for which the Customer wishes to make use of the right of withdrawal;
the progressive order number issued at the time of purchase;
data relating to the customer's bank account.
 
10. ERRORS INACCURACIES
10.a - BB Srl Muba Gioielli aims to provide constantly updated information on the Site.
However, it is not possible to guarantee that the Site is completely free of any errors. The Site may contain typing errors, errors, inaccuracies or omissions, some of which may refer to the price and availability of the Product, and to the product information sheet.
BB Srl Muba Gioielli reserves the right to correct errors, inaccuracies or omissions even after an order has been sent and also reserves the right to change or update information at any time without prior notice.

12 CONFORMITY DEFECTS
12.a - If a Product sold by BB Srl Muba Gioielli should show a manufacturing defect or if there is a discrepancy with the order made by the Customer, the Customer must follow the same procedure as in point 9.
 
13 APPLICABLE LAW AND JURISDICTION
13.a - The conditions of access to the Site are governed by the rules of Italian law and must be interpreted in accordance with Italian law
13.b - The Customer accepts the non-exclusive jurisdiction of the Italian courts. For any action deriving from or related to the conditions, navigation or use of the Site, the court of Florence will be competent.
